Navy man sues govt05 June, 2007
JOHOR BARU: A naval serviceman who suffered severe burns during a training stint last year has sued the government, Defence Minister Datuk Seri Najib Abdul Razak and nine others. The plaintiff Mohd Izwan Kemat @ Abdul Rahman, 20, claimed that his training supervisor had smothered his back, legs and arms with hot ashes from a camp fire on Aug 3.Izwan, of Bandar Baru Kangkar Pulai here, was attending a commando course at Pasir Panjang, Manjung, in Perak, when the incident occurred. He was then told by the supervisor to wash his body in the sea. He filed the writ at the Ipoh High Court on May 14.The writ of summons had been sent to all the defendants. However, the Attorney-General’s Chambers had responded saying that Najib and the government should not be parties.

Indeed the AG chambers had responded to the suit. The report mentioned the Govt and the DPM should not be parties to the suit. I believe the suit should only be against the supervisor, and that on a personal basis only.
I also believe that all other Naval personnel, mentioned in the writ but not reported, cannot be sued in their official position, only in the personal basis. I stand to be corrected, of course.
